Case No. 20-2-00308-31 SUMMONS BY PUBLICATION SUPERIOR COURT OF WASHINGTON FOR SNOHOMISH COUNTY LYNNWOOD 99, LLC, a Washington limited liability company, Plaintiff, v. ALEX KANE, an individual, Defendant. To: ALEX KANE, DEFENDANT You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty (60) days after the 29th day of January, 2020, and defend the above entitled action in the above entitled court, and answer the complaint of the plaintiff Lynnwood 99, LLC, and serve a copy of your answer upon the undersigned attorneys for plaintiff Lynnwood 99, LLC, at their office below stated; and in case of your failure so to do, judgment will be rendered against you according to the demand of the complaint, which has been filed with the clerk of said court. The Complaint is brought against you for quiet title by adverse possession and deed reformation based on mutual mistake. Plaintiff seeks to quiet title to certain real property located in Snohomish County at the address commonly known as 19020 Highway 99 in Lynnwood, Washington (the "Property"), which includes Parcels A and B. In a deed recorded in Snohomish County on August 20, 1948, you obtained title to the Property. In a deed recorded in Snohomish County on September 25, 1948, you conveyed title to the Property; however, the legal description in the deeds did not entirely match, which created a three-inch gap between Parcel A and Parcel B (the "Gap"). Plaintiff seeks to quiet title to the Gap and assert adverse possession or, in the alternative, reformation of deed based on mutual mistake. This Summons is published by order of the Honorable Susan E. Harness, Superior Court Commissioner of the above-captioned Court, made and entered on the 24th day of January 2020, directing publication of this Summons each week for six (6) consecutive weeks in the Everett Herald.
