To appeal a SEPA decision:


 


Submit a written appeal and the $500 filing fee to PW prior to 5 p.m., published appeal end date.


Refer to SCC 30.71.050(5) for details on what must be included in a written appeal. A SEPA appeal


also requires that an affidavit or declaration be filed with the Snohomish County Hearing Examiner


within seven days of filing the appeal pursuant to SCC 30.61.305(1). For projects requiring a shoreline


permit, appeals must be submitted to the Shorelines Hearings Board.

NOTICE OF LAND DISTURBING ACTIVITY AND SEPA THRESHOLD DETERMINATION


 


(Pursuant to the provisions of Chapters 30.70.050(2) and 30.61 SCC)


 


Project Name: Drainage Improvement Near140th Street SW& Serene Way (RR 48837)

Project Description:SnohomishCountyPublic Works, as part of an emergency response to address urban


lake flooding, installed approximately 600 feet of 18-inch pipe from an existing catch basin along Serene


Way to a new emergency overflow structure near theLakeSerene shoreline. The new overflow structure and


pipe system is located below grade within the existing140th Street SWright-of-way that is shared with the


Washington Department of Fish and Wildlife for boat ramp access toLakeSerene. The overflow structure


was installed landward of the lake’s ordinary high water mark at its terminus. The easternmost 16 feet of the


emergency project is located within the designated flood hazard area atLakeSerene, and an emergency flood


hazard permit approval was received for this work.


 


The new outlet augments the existing damaged lake outlet system, an 18-inch pipe across private property


that is located north of the new pipe system. The failed pipe has caused extraordinary high lake levels that


pose a threat to public infrastructure. The area in proximity to140th Street SWhas recently experienced


inundation with water due to the blocked outlet. The intent is to have the new outlet replace the existing


damaged system and provide a new outlet fromLakeSerene.


 


An additional pipe segment is essential to ensure long term functionality of the pipe system installed as part of


the initial emergency effort. Due to high water, it was not feasible at the time of the emergency response effort


to install the ultimate length of pipe needed to have the new outlet fully functional. This additional pipe segment


extends approximately 20 feet from the existing pipe terminus toLakeSerene.


 


Subsequent to the emergency response and proposal to add the additional pipe segment,SnohomishCounty


Public Works-Surface Water Management will also initiate an effort to identify a more long term solution to


the urban flooding occurring in proximity toLakeSerene. Once a proposed design has been developed,


application for permits would occur at that time.


 


Project Location: The project site is located in unincorporated southwestSnohomishCountyon140th Street


SW where the roadway terminates at a boat launch located at theLakeSerene shoreline, in Section 34,


Township 28 North, Range 4 East, W.M. ofSnohomishCountyofSnohomishCounty.

appeals related to a shoreline substantial development permit shall be submitted to the state shorelines


hearings board together with appeal of the underlying shoreline permit.
