SNOHOMISH COUNTY COUNCIL SNOHOMISH COUNTY, WASHINGTON NOTICE OF ENACTMENT NOTICE IS HEREBY GIVEN, that on Wednesday, September 12, 2018 the Snohomish County Council adopted Ordinance 18-054. A summary of the ordinance is as follows: ORDINANCE NO. 18-054 AN ORDINANCE VACATING A PORTION OF 19th AVENUE NE A SNOHOMISH COUNTY ROAD RIGHT-OF-WAY Section 1.Adopts findings of fact. Section 2.The County Council finds that road right-of-way described in Exhibit A and depicted in Exhibit B, both attached to this ordinance and incorporated herein by reference, is useless for County road purposes and the public will be benefited by its vacation. Section 3.Road right-of-way described and depicted in the attached exhibits is vacated upon satisfaction of the terms and conditions contained in this ordinance. Section 4.As required by RCW 36.87.020 and SCC 13.100.070, the vacation of the road right-of-way granted herein shall not take effect unless within one year of the date this ordinance is passed by the Council Petitioners pays in full the itemized costs and expenses as determined in the Engineer's report Section 5.Pursuant to Chapter 36.87 and SCC13.100.080, vacation of road right-of-way may not take effect unless, within one year of the date a vacation ordinance is passed by Council, a petitioner pays the County for the value of the vacated road right-of-way according to the schedule set forth in SCC 13.100.080. Here, no payment is required from Petitioners under SCC13.100.040 (7) because the road right-of-way is classified as Class D (the County only holds and easement interest and no public expenditures have been made on the right-of-way). Section 6.Upon the Clerk of the County Council receiving confirmation from the Department of Public Works that Petitioners have timely made timely and full payment of all costs as required by Chapter 36.87 RCW and Chapter 13.100 SCC, this ordinance shall be recorded and become effective. In the event Petitioners fail to make payment within one year of the date this ordinance is passed by the Council, this ordinance shall automatically become void and have no further force or effect.
