At the Planning Commission meeting on March 28, 2017, Commissioner Hannam questioned the interpretation


of SCC 2.08.120, which states in part “all actions of the commission shall be determined by a majority vote


of the commission membership at a meeting at which a quorum is present”. The issue regarding how many


votes are required for Planning Commission action has surfaced since at least 2005, with the Prosecuting


Attorney’s Office weighing in on the issue from time to time. A current memo from the Prosecuting Attorney’s


Office is attached.

The proposed code amendments clarify the requirements to provide pedestrian facilities such as sidewalks


internal to a development, address issues related to pedestrian facilities in drive aisles, add a new definition for

of Planning and Development Services to make decisions on pedestrian facilities. The Planning Commission


was briefed on this project at their March 28, 2017, meeting.

Briefing on proposed amendments to the critical area regulations (CAR), in Title 30 Snohomish County Code


(SCC), by designating three additional types of critical areas for protection as specified in WAC 365-190-


130: Naturally occurring ponds under twenty acres and their submerged aquatic beds that provide fish or


wildlife habitat; lakes, ponds, streams and rivers planted with game fish by a governmental or tribal entity; and


state natural area preserves, natural resource conservation areas, and state wildlife areas. A public hearing is


proposed for May 23, 2017.


 


2. 2017 County-initiated Comprehensive Plan Amendments: Briefing

At the conclusion of its public hearing, the County Planning Commission will consider transmitting a formal


recommendation to County Council concerning adoption of the proposal. The Commission may make a


recommendation to adopt or to not adopt the proposal. The Commission’s recommendation may also propose


amendments to the proposal. The Planning Commission is an advisory body and the final decision rests with


the County Council.
