1. As of today’s date, June 16, 2016, the Snohomish County Treasurer issues to Snohomish County, Washington, this Amended Certificate of Delinquency No. 126, in book form, with the attached Exhibit A, showing delinquent taxes, interest, and costs for the


years 2013 through 2016, and some prior years, on property subject to foreclosure inSnohomishCounty.


2. This Amended Certificate of Delinquency correctly shows: (1) a description of the property subject to foreclosure; (2) the tax years for which there are delinquent taxes; (3) the amount of taxes interest, and costs due on each parcel of property through June 2,


2016, and (4) and the known or reputed owner of the property as stated on the tax rolls.


3. Any property listed in this Amended Certificate of Delinquency No. 126 may be redeemed at any time prior to the day of its sale, as ordered by the court pursuant toSnohomishCounty’s annual tax foreclosure action, by payment to theSnohomishCounty


Treasurer of the total amount shown on Exhibit A to this Amended Certificate of Delinquency, together with additional interest at the rate of twelve percent (12%) per annum from June 15, 2016, to the date of such redemption, plus costs of foreclosure and any


penalties assessed after June 15, 2016, for delinquent 2016 taxes. The payment must be made by cash, cashier’s check, money order, or certified check.

A lawsuit has been started to foreclose real property tax liens on the property described in the Certificate of Delinquency No. 126 which was filed with the above-entitled court on June 7, 2016, under this case number. Our records reveal that you may own, or have


an interest in, a parcel or parcels described in Exhibit “A” to the Certificate of Delinquency. A description of the parcel(s) included in the Certificate of Delinquency which you own, or in which you may have an interest, is enclosed with this notice. Also enclosed with


this notice is a copy of the Complaint which was filed with the Certificate of Delinquency and a Notice of Protection: Servicemembers Civil Relief Act.


 


In order to defend against this foreclosure lawsuit, you must respond to this action by stating your defense in writing, and serve a copy upon the undersigned attorney for the plaintiff within thirty (30) days after service of this summons and notice, excluding the day


of service, or pay the amount due for taxes, interest, and costs. If you do not, a default judgment may be entered against you without notice. A default judgment is one where the plaintiff is entitled to what it asks for because you have not responded. THE JUDGMENT


WOULD BE AGAINST THE PROPERTY AND NOT A PERSONAL JUDGMENT AGAINST YOU. If you serve a notice of appearance on the undersigned attorney, you are entitled to notice before a default judgment may be entered.


 


If you wish to seek the advice of an attorney in this matter, you should do so promptly so that your written response, if any, may be served on time.


 


If judgment is entered against the property, either by default or after a hearing by the court, the property will be sold at public auction, unless redeemed before the close of business the day before the day of sale.


 


If you wish to redeem this property (i.e., keep this property out of the foreclosure sale), payment of taxes, interest, and costs, including title search, publication, and administrative costs, any time before the close of business the day before the day of sale will

SnohomishCounty’s Complaint for Foreclosure of Liens for Delinquent Real Property Taxes, Interest and Costs


 


SnohomishCountyalleges as follows:


 


I. PARTIES


1.1 The plaintiff is a political subdivision of the State ofWashington.


1.2 This lawsuit is an in rem proceeding pursuant to chapter 84.64 RCW against all of the properties identified on Exhibit A to the Certificate of Delinquency No. 126 filed with this complaint on June 7, 2016. The Certificate of Delinquency No. 126 contains a legal


description for each parcel of property subject to this action.


II. JURISDICTION AND VENUE


2.1 Jurisdiction is properly before this court pursuant to RCW 84.64.050.


2.2 Venue is proper inSnohomishCountypursuant to RCW 4.12.010.


III. FACTS


3.1SnohomishCountybrings this action pursuant to chapter 84.64 RCW.


3.2 The Snohomish County Treasurer issued Certificate of Delinquency No. 126 in book form, to the plaintiff and filed the same with the Clerk of the Court on June 7, 2016.


3.3 The Certificate of Delinquency No. 126, filed with this court on June 7, 2016, identifies properties in Snohomish County that have delinquent taxes, interest and costs for the years 2013 through 2016, and some prior years.


3.4 Certificate of Delinquency No. 126 correctly shows: (1) a description of the property subject to foreclosure; (2) the tax years for which there are delinquent taxes, interest, and costs; (3) the amount of taxes, interest, and costs due on each property through June


2, 2016; and (4) the known or reputed owner(s) of the property as stated onSnohomishCounty’s tax rolls.


3.5 The real properties particularly described in the Certificate of Delinquency No. 126 were duly listed for taxes, and the assessment, levy, and equalization of taxes thereon, and all other acts required by law to be done to make the taxes a valid, first lien upon


the property for the collection thereof, were duly, regularly, timely, and properly done.


3.6 The lien and claim of the plaintiff is a first lien and paramount to any claim, title, right, lien, interest, or estate in, to or upon the real properties herein pursuant to chapter 84.60 RCW.


3.7 Interest on the taxes and costs owing accrues at the rate of twelve percent (12%) per year. An additional penalty of three percent (3%) of the 2016 property tax was assessed on June 1, 2016, and an additional eight percent (8%) of the 2016 property tax will


be assessed on December 1, 2016.


3.8 Pursuant to chapter 84.64 RCW,SnohomishCountyis entitled to foreclose the liens for taxes, interest, and costs, and sell all parcels of property identified on Exhibit A to the Certificate of Delinquency No. 126 which have not been redeemed prior to the day


of sale.


IV. PRAYER FOR RELIEF


Having fully set forth its claims,SnohomishCountyprays for the following relief:


 


4.1 That the Court enter judgment foreclosing the liens on the properties identified on Exhibit A to the Certificate of Delinquency No. 126 pursuant to RCW 84.64.080;


4.2 That the Court enter an Order pursuant to RCW 84.64.080 allowing Snohomish County to sell all of the properties which have not been redeemed prior to the day of sale.


4.3 For all other relief which is just and equitable.

Notice of Protection: Servicemembers Civil Relief Act


 


TO: Active Military Service Members and their Dependents


 


Federal law provides protection to defendants who are on active duty in the military service and their dependents. Dependents of a service member are the service member’s spouse, the service member’s minor child, or an individual for whom the service member


provided more than one-half of the individual’s support for one-hundred-eighty (180) days immediately preceding an application for relief under the Federal Servicemembers Civil Relief Act.


 


One protection provided is a limitation on sale of property to enforce tax assessment. This notice pertains to taxes or assessments that fall due and remain unpaid during a period of military service. Defendants in military service may also have other rights and


protections not covered by this notice.


 


If you are a service member on active duty in military service or the dependent of an active duty service member, you should notify the plaintiff’s (Snohomish County’s) attorneys in writing of your status as such within twenty (20) days of the


receipt of this notice. If you fail to do so, then a court may presume that you are not on active duty, or a dependent of an active duty service member, and enter an order that military service does not materially affect your ability to pay the unpaid tax or assessment.


Your response to the plaintiff’s attorneys about your status does not constitute an appearance for jurisdictional purposes in any pending litigation nor a waiver of your rights.
